HOUSE BILL NO. 282

An act to prohibit certain food establishments from serving food to any person who is obese, based on criteria prescribed by the state department of health; to direct the department to prepare written materials that describe and explain the criteria for determining whether a person is obese and to provide those materials to the food establishments; to direct the department to monitor the food establishments for compliance with the provisions of this act; and for related purposes. Be it enacted by the legislature of the state of Mississippi:

SECTION 1.

(1) The provisions of this section shall apply to any food establishment that is required to obtain a permit from the State Department of Health under Section 41-3-15(4)(f), that operates primarily in an enclosed facility and that has five (5) or more seats for customers.

(2) Any food establishment to which this section applies shall not be allowed to serve food to any person who is obese, based on criteria prescribed by the State Department of Health after consultation with the Mississippi Council on Obesity Prevention and Management established under Section 41-101-1 or its successor. The State Department of Health shall prepare written materials that describe and explain the criteria for determining whether a person is obese, and shall provide those materials to all food establishments to which this section applies. A food establishment shall be entitled to rely on the criteria for obesity in those written materials when determining whether or not it is allowed to serve food to any person.

(3) The State Department of Health shall monitor the food establishments to which this section applies for compliance with the provisions of this section, and may revoke the permit of any food establishment that repeatedly violates the provisions of this section.

SECTION 2. This act shall take effect and be in force from and after July 1, 2008.

Well you people can make fun of this all you want. I don't eat at Mac Lounge so i really don't care about that.

In my Dr.s eyes i'm obese. I'm 6'1" and 2051bs. My wife is considered obese by her Dr. also.

I hardly doubt that all CDF's members are lean.

By these standards nearly every adult is obese. Unless that is 2,051 pounds and not 205 LBS.

is this not discrimination? how can you just deny service to someone with shirt and shoes.

my work has us take health assessments every year and you would be very surprised how un-healthy everyone seems to be to our insurance company.

Well, I'm laughing, but only to prevent myself from screaming at the insanity of this stuff.

We've all seen this outrageous behavior from legislators (not to mention how long we've endured the insanity from the judicial branch of govt)...unless you've been living in a cave .

From legislating my trans fatty acid intake, to telling me how to raise my children, to taxing cigarettes out of existence...and no I don't smoke, but that's not the point, and on and on ad nauseum, the government has clearly overstepped its bounds.

The Federal Government is supposed to provide for national security and defense. Last time I looked, I don't think its job included determining the critical mass of fat that can be safely enconched in a sarah lee danish or how much of it I can consume based on my body index and age or predisposition to addiction.
(With the likelihood of a single party payer national health care system, do you think I'll be able to get "free" liposuction?)

As far as local govt, I'm pretty sure they're supposed to be on the hook for our kids' education, schools, roads and bridges...you know the incidental items that touch our lives.
I don't know about your state, but the last time I looked, our education is a mess, I need a front-end alignment about every 5,000-10,000 miles and I plan my travel over bridges on days when there's little to no wind.
Call me crazy, but I don't feel it's because I'm not paying my fair share!

But thank heaven at the King Middle School in Portland Maine, the school board passed a resolution last Oct. so that your 11, 12, 13 and 14 year old daughters can get various forms of birth control, including birth control pills. And the best part...if you gave consent that your child can be seen at the health clinic (this is an all or nothing consent) probably thinking something silly like she might need to be seen for an asthma attack or a fractured wrist...guess what?...right again. This is priviledged and confidential info and can only be released to you after your child consents (you're just the parent after all...come on, you know the school knows best) . So don't give a thought to the fact that your 11 year old daughter is staying late to play with three 14 year old boys or the 17 year old boy that joined in from the high school next door, she won't get pregnant. Oh darn, those pills don't prevent STD's do they?
But still no cause for alarm, since she's afraid and has been warned not to tell you, you'll never know.

Thankfully, after threatened with being tarred and feathered, the board agreed to have another look and rescinded their previous decision.
Yeah, it was those incompetent, unknowing, silly parents again.

I don't know about you, but as Uncle Sam reaches farther and farther into my wallet these days, I'm feeling more and more constipated.

Oh well, the really important thing is that the govt is watching the size of my waistline...

IMO, all this attention toward restricting food is the governments attempt to keep Medicare from going bankrupt sooner than later. The medical costs of treating disease caused by carrying too much weight is going to be staggering. This is just the tip of the iceberg and it will get much worse in the future. Look for them to deny certain medical services/procedures to overweight patients before long.

All the FDA has to do is ban MSG. It's the leading cause to bet you can't eat just one

They could do a lot in the USA if they just stopped companies from making everything bigger without any way of buying something smaller. I you go into any service station or small store now most do not carry the 12 oz can of soft drink any more. You are lucky if you can find on that is 24 oz. The soft drink companis would say well we sell diet but not all people can stand to drink diet. So you go into the store with kids and they say they want a drink so you end up getting a 24 oz, which the ones who should not be drinking it will drink the whole thing. Sent coke and pepsi an email about this and said why not sell a 8 oz drink but received nothing back form them because they up the sizes and up the prices so they make more on the large ones.
(IF YOU BUY IT YOU WILL DRINK IT OR EAT IT)

Agreed ...the government has put a limit to the maximum size of Junk Food meals in Oz ...
Pity that the god forsaken Heart Tick Foundation gave the Heart Tick approval to Macca's for miniature sized meals on the basis that they didn't have enough fat to be unhealthy.
What they obviously didn't consider was the meals that they approved wouldn't feed a 2ft, 10KG midget, so any normal person would be required to purchase two ... a situation which pushes the meals into the incredibly unhealthy category.

I wish the Heart Foundation would introduce a per unit weight scale.

There is a solution to being to big it is called basic training it worked for me in 1965 I went in at 265 pounds and came out 178.
