DVD Copyright Question - Club CDFreaks

Didn't know where else to put this question, so here goes.
The movie assoc. or whoever doesn't like people making copies of their movies. For awhile now I've wondered this:
If you own a movie, you can make a legal backup.
What if somebody goes to Wal-Mart or wherever, buys a movie, makes a legal backup, and then sells the original movie to a friend or something. Does that make the backup you still have "illegal"?

Following on from what bjkg stated , every country is different when it comes to legal issues...what may be deemed as acceptable in Britain may not hold any sway in America.
