Scan the MP3 with MP3Utility, or scan the folder its in with EncSpot. Or play the MP3 in WinAMP or foobar2000. Any of those programs I mentioned will tell you the actual bitrate of the MP3.

Windows Media Player and Windows just aren't at all reliable for detecting strange MP3's bitrates.
